EU-Commission requests Belgian to change its restrictive exit tax provisions for companies.

The European Commission has recently requested Belgium to change its "exit tax" rule that applies in case a Belgian (corporate) tax resident migrates abroad. The Commission considers this provision to be incompatible with the freedom of establishment.

In case Belgium does not take action within two months, the European Commission can introduce the case before the European Court of Justice.

We will keep you posted on new developments in this area.
