The Belgian participation exemption (again) under fire |

On 20 November 2009, the European Commission has sent a reasoned opinion to Belgium challenging the Belgian participation exemption (reference number 2007/4333). According to the Commission the requirement under Belgian legislation that the shareholding must qualify as financial fixed assets for the participation exemption to apply, is not in line with the Parent-Subsidiary Directive. |
